Digital Millennium Copyright Act — Notice & Takedown Procedure

DMCA Compliance Statement

Sinister Printworks LLC (“Sinister Printworks”) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (“DMCA”). We have designated an agent with the U.S. Copyright Office to receive notifications of claimed copyright infringement in accordance with the DMCA.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied, uploaded, or used through our service in a way that constitutes copyright infringement, you may submit a written notification to our Designated Agent. Under the DMCA, your notice must include the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest;
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit Sinister Printworks to locate the material (e.g., order number, file name, description of the design);
  4. Your contact information, including address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe that material you submitted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. Your counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Sinister Printworks may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Repeat Infringer Policy

In accordance with the DMCA, Sinister Printworks maintains a policy to terminate, in appropriate circumstances, the accounts or access of users who are repeat infringers of copyrighted material. If a user is found to have repeatedly submitted designs that infringe upon third-party copyrights, Sinister Printworks will take reasonable steps to terminate that user’s access to our services.

Good Faith Warning

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorney’s fees. Do not file a DMCA notice or counter-notification unless you are certain of your claims.
